PETITION UNDER ORDER 39 RULE 2 (3) CPC FOR INITIATING CONTEMPT OF COURT
PROCEEDINGS AGAINST THE RESPONDENT/CONTEMNOR FOR HIS WILLFUL AND DELIBERATE
DISOBEDIENCE OF THE INJUNCTIVE ORDER PASSED BY THIS HON’BLE COURT.

Sheweth,
1. That
the petitioner filed the above-titled suit
which is pending adjudication before this Hon’ble Court and this Hon’ble
court and fixed for today.
2. That
on 13.10.2021, this Hon’ble court passed injunctive order by restraining the
defendant /respondent from illegally interfering in the possession of the
plaintiff/petitioner over the suit property.
3. That
the notices were duly served to the respondent and the respondent is well aware
of the injunctive order of this Hon’ble court but the respondent with the help
of others constructed a wall over the suit property after the injunctive order
of this Hon’ble court willfully and deliberately violating the order of this
Hon’ble court and also stared interference over the suit property illegally,
unlawfully as well as by violating the injunctive order of this Hon’ble court just
to usurp the valuable property owned by the petitioner. (Pictures are attached
herewith for kind perusal of this Hon’ble court)
4. That
the respondent deliberately and willfully committed contempt of court by
violating the order of this Hon’ble court.
5. That
the act of the respondent is illegal and willful contempt of court and he is liable
to be punished in accordance with the law.
In view of the above circumstances, it
is, therefore, most humbly prayed that instant application may kindly be
accepted and the contempt of court proceedings may kindly be initiated against
the respondent for his willful and deliberate disobedience of the injunctive
order passed by this Hon’ble Court and be punished as per law, which is in the
interest of justice.
Any other relief which this Hon’ble Court
deems fit and proper may also be awarded to the petitioner.
