Respectfully Sheweth;
That the petitioner is
complainant of the above-said case which is pending adjudication before this
Hon’ble Court for further proceedings.
That the petitioner is the real
paternal uncle of the deceased and the complainant of the instant FIR. The petitioner
is seeking permission to effect compromise as the legal heir of the deceased.
That all the legal heirs of the
deceased including the petitioner entered into the compromise with all accused
persons, compound the offense, and waived the right of Qisas and Diyat in the
name of Almighty Allah, the deceased was survived by the following legal heirs
(give detail of legal heirs of deceased including relations with the deceased).
That list of the legal heirs
prepared and verified by the Chairman Union Council concerned is annexed herewith
to the petition and in this regard, all the legal heirs of the deceased
submitted affidavits and are ready to record their statements before this
Hon’ble court.
That the offenses mentioned in the
above caption case are compoundable and fall under section 345 (2) Cr.P.C.
That the legal heirs of the
deceased are ready to submit their affidavits and also want to record their
statement before this Hon’ble Court to the effect that they have forgiven the
accused in the name of Almighty Allah and do not want to proceed further and
also have no objection on the acquittal of accused persons.
That the compromise has arrived
between the parties that they could forget the existing estrangement and could
live in harmony in peace.
That the compromise between the
parties arrived without any coercion, duress, pressure, compulsion, or deception.
PRAYER:
In view of the above
circumstance, it is, therefore, most respectfully prayed that the instant
petition may kindly be accepted in the interest of future cordial relation and
may kindly be acquitted the accused from the charge on the basis of compromise,
in the interest of justice.
