Application for consolidation of cases.

Purpose: To consolidate different cases in a single court, which are pending between the same parties and the same subject matter.

 IN THE COURT OF LEARNED DISTRICT & SESSIONS JUDGE, (NAME OF DISTRICT)

 APPLICATION FOR CONSOLIDATION OF CASES/ SUITS

 Respectfully Sheweth,

 

1.   That the applicant being the plaintiff filed a suit for declaration, specific performance of an agreement to sell, etc titled as “ ABC Vs XYZ” is pending in the court of (name of the judge), learned Civil Judge, Jhelum and same is fixed for 06.03.2019, whereas, another suit for permanent and mandatory injunction titled as “XYZ Vs ABC, etc” filed by the respondent/defendant, which is pending in the court of (name of the judge), learned Civil Judge, Rawalpindi which is fixed for 13.03.2019.

 

2.   That both the above-mentioned suits are pending between the same parties in two different courts regarding the same suit property, therefore, to avoid the conflicting judgment and for the conveyance of the parties, it is necessary to consolidate both the above-cited suits in one court.  

 

3.   That if the mentioned above suit are not consolidated in one court, then the applicant may suffer irreparable loss.

 

In view of the above, it is, therefore, most humbly prayed that by accepting the application in hand, both the above-referred suits may be consolidated in one court, in the interest of justice.  

Any other relief that this Hon’ble Court deems fit and proper may also be granted to the applicant.
