Purpose: Seek implementation/compliance of the order of a justice of the peace (JOP), which the court passed in petition U/S 22-A Cr-P-C.

PETITION UNDER SECTION 22-B Cr.P.C
Respectfully Sheweth,
That the petitioner being arraigned by the local
police/respondents, filed petition U/S 22-A Cr.P.C before this Hon’ble court
which was entrusted to the court of learned Ex-Officio Justice of Peace /ASJ,
whereby the learned ASJ, issued direction to the respondent No. 2 vide order
dated 17.03.2021 for registration of a criminal case.
That petitioner approached respondent No. 2 along
with the certified copy of the order dated 17.03.2021 which was duly received
by him but astonishingly the respondent incorporated a Qalandara U/S 337AI PPC
despite recording the cross version on the application of the petitioner, which
is a clear violation of above-said order of this Hon’ble court.
That the respondents are intentionally and
willfully disobeying the order passed by this Hon’ble court, hence committed
negligence, failure, and excess of their authority in relation to their functions
and duties.
That the respondents did not implement the order
passed by the learned Ex-Officio Justice of Peace willfully, hence respondents
committed offense U/S 154 Cr.P.C and Police Order 2002. Reliance 2013 PLJ 630.
That the petitioner has no other speedy remedy
against the respondents except to knock on the door of this Hon’ble court
again, hence this petition.
PRAYER:
In view of the above circumstances, it is, most
respectfully prayed that the instant petition may kindly be accepted and the
respondents may graciously be directed to implement the order dated 17.03.2021 passed
by Ex-Officio Justice of Peace and register a criminal case against the culprits
and contempt proceeding may also be initiated against the respondent No.2, in
the interest of justice.
