Purpose: For submission of surety bond before the court of criminal law.
PETITION U/S 91 CR.P.C FOR THE SUBMISSION OF SURETY
BOND ON BEHALF OF PETITIONERS
Respectfully Sheweth:
That the brief facts of the instant case are that on the complaint of Mr. Jaser an FIR No. 57, Dated 10.03.2013, U/ S 365, 337-J PPC, was registered in the concerned police station, thereafter the petitioners appeared and joined the investigation in the above said FIR and produced their respective evidence in support of their plea and ultimately their name was placed in column No. 2 of report U/S 173 Cr.P.C, in which Hon’ble Court summoned the accused, who submit the bail bond U/S 91 Cr.P.C in compliance of the order of the Hon’ble court, while aggrieved party filed a private complaint U/S 200 Cr. P.C, in which the Hon’ble court after recording the cursory statements, issued summons to face a trial in the connection with a private complaint U/S 204 Cr. P.C, hence instant petition is preferred on inter alia:-
GROUNDS
That after the registration of the case, the
petitioner joined the investigation of the police, who were not arrested, and the
petitioners were declared innocent and placed their name in column No. 2 of
report U/S 173 Cr. P.C after taking cognizance, the Hon’ble court issued the
summon against the petitioners, and in compliance the petitioners submitted the
bail bond U/S 91 Cr.P.C in the instant case.
That the section 91 Cr.P.C empowers the court to take
bond for appearance when any person for whose appearance or arrest the officer
presiding in any court is empowered to issue a summon or warrant, is present in
such Court, such officer may require such person to execute a bond, who or
without sureties, for his appearance in such court.
That in the present case learned trial court took cognizance
U/S 190 Cr.P.C, then the proceeding of commencing issuing the process U/S 204
Cr.P.C for the appearance of the petitioners before the Hon’ble Court, the
attendance of the present petitioner is required to this Hon’ble court and the petitioners
are ready to furnish the surety bond for the satisfaction of the Hon’ble Court.
PRAYER
It is, therefore, most respectfully prayed, that
the instant application may kindly be accepted and the petitioners may graciously
be allowed to submit a surety bond, in the best interest of justice.
