PETITION FOR
PARTITION OF AGRICULTURAL LAND BEARING KHEWAT NO. 001 & 002, KHASRA NO. 003,
645, 264, 267, SITUATED IN THE REVENUE ESTATE OF XYZ, TEHSIL & DISTRICT ABC
Respectfully
Sheweth:-
That the petitioners and respondents are owners and co-sharers in land bearing Khewat No.
001 & 002, Khasra No. 003, 645, 264, 267, situated in the revenue estate of
xyz, Tehsil & District abc and whole the property in question is consisting
of land measuring 4 Kanals & 3 Marlas, out of which
the petitioners and other co-sharers are owners of 3 Kanals and 8 Marlas,
whereas the respondents are the subsequent purchasers of land measuring 14
marlas (136 Sq ft). Admittedly the petitioners have been enjoying the ancestral
property, while the respondents purchased the above-cited land measuring 14
marlas from one of the co-sharers.
Petitioner No. 1 is a permanent resident of the United Kingdom from last
so many years and his attorney look after the property matter on his behalf. On
06.12.2016, vide dairy No. A-8801 an application was received by the city
police officer through overseas Pakistanis that the respondents with the help
of some land grabbers forcibly occupied the land of the petitioners and other
co-sharers, despite knowing this thing that the respondents are owners only to
the extent of 14 Marlas (136 Sq ft) but even then the whole khasra No. 644, 645
was forcibly taken by the respondents and till now the respondents are illegally occupying the disputed land and
upon the above said illegal act, a criminal case was registered against the
respondent, in which during the course of an investigation, respondent was found
guilty and pre-arrest bail of the respondents was dismissed by the court of
competent jurisdiction.
That the property in question is not portioned yet among the parties
and the petitioners asked the respondents several times to get legally
partition the property in question as per law but instead of partitioning, respondents
extended threats of dire consequences to the petitioners in order to grab the
valuable shares of petitioners, hence the petitioners are seeking partition of property
in question.
That if the instant petition is not accepted and the suit property not
be partitioned, the petitioners shall suffer irreparable loss.
That the suit property is situated within the territorial limits of
this Hon’ble court, hence this Hon’ble court has jurisdiction to try and
adjudicate upon the matter.
PRAYER:
In view of the above circumstances, it is, therefore, most
respectfully prayed that by accepting the instant petition, the suit property land bearing Khewat No. 001 & 002, Khasra No. 003, 645, 264,
267, situated in the revenue estate of xyz, Tehsil & District abc, may
kindly be partitioned, in the interest of justice.
